Terms of use
These terms of use govern access to and use of the Iberis HR platform, published by Birou Suite SARL, a company incorporated under Tunisian law. By creating an account or using the service, you accept these terms in full.
1. Parties to the agreement
This agreement is entered into between Birou Suite SARL ("Iberis Suite", "the provider"), publisher of the Iberis HR platform, and any natural or legal person ("the user", "the customer") who registers for and uses the service. Iberis Suite is a Tunisian company specialised in publishing SaaS business management software.
2. Acceptance of the terms
By accessing Iberis HR, creating an account or using the service, you acknowledge that you have read, understood and accepted these terms. If you are acting on behalf of an organisation, you declare that you have the authority to bind that organisation. Continued use of the service after any change to the terms constitutes acceptance of the new terms.
3. Description of the service
Iberis HR is a SaaS (Software as a Service) human resources management platform that covers: employee and department management, time tracking with geolocation and facial recognition, leave and absence management, employment contract management, performance appraisal, HR reports and permissions. The service is accessed through a web browser and requires no local installation.
4. Changes to the service
Iberis Suite reserves the right to modify, suspend or discontinue all or part of the service at any time, with or without notice. We endeavour to notify major changes by email or through an in-app notification. New features are subject to these terms.
5. Registration obligations
To use Iberis HR, you must create an account and provide accurate, up-to-date information. You are responsible for keeping your login credentials confidential and for any activity carried out under your account. You must be at least 18 years old to create an account. Two-factor authentication (2FA) is recommended for administrator accounts.
6. Personal information
The processing of personal data is governed by our privacy policy. As an employer using Iberis HR, you are responsible for processing your employees' data and must ensure that you have the necessary legal grounds, in particular for collecting biometric data (facial recognition) and geolocation data.
7. Communications
By using the service, you agree to receive emails related to the operation of the service: clock-in notifications, leave requests, anomaly alerts, contract reminders and service updates. You can configure your notification preferences in your profile.
8. Pricing and payment
Iberis HR offers a free plan and a premium plan. Premium prices are displayed in Tunisian Dinar (TND), excluding tax. VAT of 19% and the 1 TND fiscal stamp are applied in accordance with Tunisian law. Payments are processed through the Konnect gateway. Subscriptions renew automatically. You may cancel at any time, and access remains active until the end of the paid period.
9. Use restrictions
The following is prohibited: using the service for unlawful purposes, attempting to access other users' data, reverse-engineering or decompiling the software, using unauthorised bots or automated scripts, intentionally overloading the servers, reselling or sublicensing the service without written authorisation, or using the service to store unlawful content.
10. Ownership of data
You retain full ownership of the data you enter into Iberis HR. We claim no ownership rights over your data. Upon termination, your data remains available for export for 30 days, after which it is deleted from our servers. We perform regular automatic backups to keep data safe.
11. Intellectual property
The Iberis HR platform, including its source code, design, trademarks and content, is the exclusive property of Birou Suite SARL. Any unauthorised reproduction, modification or distribution is prohibited. The name "Iberis", the logo and the visual elements are registered trademarks of Birou Suite SARL.
12. Disclaimer
The service is provided "as is". Iberis Suite does not warrant that the service will be free of errors or interruptions. We are not responsible for HR decisions taken on the basis of the data held in the service. Compliance reports are indicative and do not replace professional legal advice.
13. Limitation of liability
In no event shall the total liability of Iberis Suite exceed the amount of the fees paid by the customer over the last 12 months. Iberis Suite shall not be liable for indirect damages, loss of data (beyond backups), loss of profits or business interruption resulting from the use of, or inability to use, the service.
14. Suspension and termination
Iberis Suite may suspend or terminate your access in the event of: breach of these terms, non-payment of subscription fees, abusive use of the service, or at the request of the competent authorities. You may terminate your account at any time from the settings. Termination leads to the deletion of your data after the 30-day retention period.
15. Governing law
These terms are governed by Tunisian law. Any dispute shall be submitted to the exclusive jurisdiction of the courts of Tunis, Tunisia. In the event of a conflict between these terms and specific agreements, the specific agreements shall prevail.
